When you purchase or use the products / services of HireBrilly, it means that you have read, understood, and agreed to be bound by these Terms and Conditions of Sales. The Terms and Conditions of Sales apply when you are:

  • advertising Jobs on the platform, using the Basic Plan
  • advertising Jobs on the platform, using Hire Brilliant Plan / Other Paid Plans, and
  • using other products / services offered by HireBrilly.
  1. Definitions

    Under this Terms of Service, unless the context otherwise requires, the following words and expressions shall have the following meanings:

    1. We”, Our Company” refers to HIREBRILLY
    2. HireBrilly” refers to its website
    3. You” refers to an individual or company using this platform, no matter if he/she is a visitor or account owner.
    4. An “account” refers to the job seeker or employer account (including the extended account users)
    5. Job Seeker refers to the members registering a Job Seeker Account on HireBrilly. Please refer to the Terms and Conditions for Job Seeker Account for more details.
    6. Employer refers to the members registering an Employer Account on HireBrilly, including an individual, company / organization, contact person of the company / organization, and employees. Also, it refers to the Human Resources Agents / Agencies (declaration is required for account registration). Click the Terms and Conditions for Employer Account for more details.
    7. A "Staffing Consultant/Recruitment Agency" is a company that provides employment services through an employment agency in Hong Kong. When registering for an employer account on HireBrilly, the company will be required to provide proof of business registration and employment agency license information. Such accounts will not be able to post jobs through the Basic Plan.
    8. Basic Plan and Hire Brilliant Plan / Other Paid Plans refers to the plans the employer chose for job advertisement.
    9. E-Voucher means the electronic vouchers issued to employer account owners by HireBrilly.
    10. Sales Orders refer to the services and products purchased from HireBrilly. For details of the purchase, please refer to the “Subscription and Payment Record” on the platform.
  2. Sales Orders

    All products / services purchased are deemed to be provided to the organization registering the Employer Account. No transfer of sales orders to other third parties / organizations without our written consent.

  3. Fee and Payment
    1. HireBrilly has the right to update the charges for its products / services.
    2. Once the payment is made for the sales order, it is not refundable.
    3. Unless otherwise specified, all currency references are in HK dollars and the date-and-time we refer to is Hong Kong Time Zone.
    4. All products or services of HireBrilly will be provided upon the payment completion.
    5. Once you have completed the payment for the Order with us, you shall, to the fullest extent permitted by the applicable law, neither cancel nor vary the Order howsoever. We shall have sole and absolute discretion to accept or decline any or all parts of your Order without giving any reason.
    6. The Employer shall be solely responsible for any bank charges incurred for the bank-in / transfer.
  4. Job Postings
    1. The Employer understands and agrees that all quota (no matter the quota is of Basic or Hire Brilliant / Other Paid Plans) must be used for job postings for its organization and no other entity (including its subsidiary / conglomerate), organization or person.
    2. Each job posting is restricted to ONE job role only.
    3. The Employer must ensure the content of the job posting is:
      1. complying the Guidelines for Job Postings of HireBrilly
      2. accurate, legal, true, and no misrepresentations
      3. complying the law and regulations of Hong Kong (or local, if applicable), including but not limit to: Labor Legislations, Disability Discrimination Ordinance, Sex Discrimination Ordinance, Race Discrimination Ordinance, Family Status Discrimination Ordinance, and The Personal Data (Privacy) Ordinance. 
      4. not consisting elements of discrimination, or will employ persons fulfilling specific criteria only (including but not limited to age, gender, disability, marital status, race). If the employer believes some specific criteria are necessary for employment, he/she must clearly explain this in the job posting. And,
      5. advertised solely for the purpose of employment. For example, it has to be non-commercial and non-sales.

      If we believe the content / purpose of the job posting violates any of our terms and conditions, we have the absolute rights to reject / suspend the job postings, without giving any reasons and without compensation / refund.

    4. Employers must ensure that they use the company logo, banners and images of their organization. Only one company logo is allowed per job posting.
    5. The Employer must ensure the content of the job posting (including the writing, company logo, banners, and images) does not constitute copyright infringement, modification, copying, and/or reproduction of the material of any party. HireBrilly has the absolute right to reject / suspend the job postings, without any reason and compensation / refund. 
    6. The Employer must ensure that all links included in their job postings lead to their company website, not to any irrelevant website(s).
    7. Period 

      A job posting will be published on the platform on and from the posting date until the expiry date, unless:

      1. it is rejected or removed as it violates the any terms and conditions of HireBrilly, or
      2. it is removed by the Employer.
    8. HireBrilly takes no responsibility whatsoever for any material on the platform that is not posted by us, or is otherwise posted by us on behalf of a user. We also reserve the right to delete the content, or suspend the accounts concerned without giving any reason. In the event of any damages caused to HireBrilly, we reserve the right to take legal action against the account holder.
  5. Basic and Hire Brilliant / Other Paid Plans
    1. The Basic Plan is not available for employer accounts registered with a staffing consultant/recruitment agencies. Employer accounts in this category can only post jobs through the Hire Brilliant Plan.
    2. A Basic Plan is valid for 1 month (e.g. 10th April to 9th May), from the date of registration of the Employer Account (if no Hire Brilliant / Paid Plans have been purchased). During this period, each Employer Account is entitled to 100 job postings. When the Basic Plan expires, a new Basic Plan will be activated the following day. 
    3. Each quota of Basic or Hire Brilliant / Other Paid Plans is restricted to 1 job posting only.
    4. Under these circumstances, any unused quota of Basic Plan will revert to zero:
      1. the expiry of Basic Plan, or
      2. your purchase of Hire Brilliant / Other Paid Plans - the Basic Plan shall become invalid with immediate effect (as does the original expiry date). A new Basic Plan will be activated the following day after all Hire Brilliant / Other Paid Plans have expired.
    5. If the job posting violates the terms and conditions of HireBrilly and is removed by us, the deducted quota will not be restored.
    6. If the job posting is rejected for advertisement, the quota will not be deducted.
    7. When the Hire Brilliant / Other Paid Plan is in effect:
      1. the job postings waiting for approval for advertisement will not be affected
      2. the job postings that are currently advertised using Basic Plan will not be upgraded
      3. recruiters can purchase the top-up quotas for job postings, and will be available from the time of payment confirmation until the end of the Hire Brilliant Plan.
    8. No resale or transfer of the unused quota under any circumstances.
    9. Under any circumstances, the unused quota is non-exchangeable for cash, e-coupons, or price deduction to other products / services.
    10. In case there is more than one Paid Plan valid for job posting, the employer can choose the plan to deduct quota from. The deduction of quota must be confirmed when the application is submitted.
    11. Regardless of whether the user is using the Basic or Hire Brilliant / Paid Plan, we are not responsible for reminding the users to use up all the unused balance within the usage period. All unused balances (including paid add-ons) will not be reissued or extended.
  6. E-Voucher
    1. Unless otherwise specified, all vouchers will be issued in electronic form.
    2. All e-vouchers shall be issued to the Employer Accounts only.
    3. HireBrilly takes no responsibility to send reminders before the expiry date of the e-vouchers. No restorations or extensions of e-vouchers will be allowed.
    4. Please make sure to use your e-vouchers before the payment. No e-vouchers can be added to a sales order once the payment is completed.
    5. All e-vouchers are non-transferrable.
    6. Unless otherwise specified, an e-voucher shall be used at once. It cannot be used in conjunction with other e-vouchers, discounts, or other promotional offers.
    7. Unless otherwise specified, all currency references are in Hong Kong Dollars, and the e-vouchers are non-exchangeable for cash, e-coupons, or price deduction to other products / services.
  7. Force Majeure

    If the performance by us under this platform is prevented by reason of force majeure, including but not limit to war, fire, casualties, accident, act of God, natural disaster, epidemic, pandemic, any law, order, declaration, demand or requirement of the Government of Hong Kong or of any of its government agencies, strikes, labor disputes / shortage, disruption of communication and electronic networks, or other causes whatsoever beyond the reasonable control of us, we shall not be liable from such performance to the extent of such prevention, or be deemed to be breach of the Contract and/or these conditions.

  8. Others
    1. The Employer may not assign, subcontract or encumber any right or obligation under the Contract, in whole or in part, without HireBrilly's prior written consent.
    2. HireBrilly reserves the right of final decision relating to this Terms and Conditions for Sales, and any dispute thereof.
    3. We reserve the right to change these conditions with prior written notice at any time, at HireBrilly's sole discretion, by posting a copy of the amended conditions on the platform. The amended conditions shall be effective upon posting on the platform.
