By using HireBrilly, you agree to be bound by this Terms of Service (“the terms”) and Privacy Policy. Please read them carefully before using this platform. Do not use this platform if you disagree with the Terms of Service (“the terms”) and Privacy Policy.

  1. Definition

    Under this Terms of Service, unless the context otherwise requires, the following words and expressions shall have the following meanings:

    1. We”,Our Company” refers to HIREBRILLY
    2. HireBrilly” refers to its website or mobile application
    3. You” refers to an individual or company using this platform, no matter if he/she is a visitor or account owner.
    4. An “account” refers to the Job Seeker or Employer account (including the extended account users)
    5. Job Seeker refers to the members registering a Job Seeker Account on HireBrilly. Please refer to the Terms and Conditions for Job Seeker Account for more details. 
    6. Employer refers to the members registering an Employer Account on HireBrilly, including an individual, company / organization, contact person of the company / organization, and employees. Also, it refers to the Human Resources Agents / Agencies (declaration is required for account registration). Click the Terms and Conditions for Employer Account for more details.
  2. The Role of HireBrilly

    We offer a technology platform to provide employment information to Job Seekers and Employers. You understand and agree that HireBrilly is a third party platform, and:

    1. neither we are the medium / agent between the Job Seeker and Employer, nor an employment agency / service provider
    2. we are not involved in any employment decisions made by the Employer, and
    3. any employment agreements, including but not limited to interview arrangements, employment agreements and contracts, are the matters between the Job Seeker and the Employer. You acknowledge that HireBrilly has never been and will never be a party to any part of the recruitment process. In the event of any dispute relating to the employment, you understand that HireBrilly is not obliged to mediate, and that dispute must be taken up by the Job Seeker and the Employer.
  3. Use of HireBrilly
    1. You understand and agree that following actions (included but not limited to) are prohibited in HireBrilly:
      1. to post content which is illegal, libelous, fraudulent, threatening, discriminatory, defamatory,  obscene, sexual, or makes people get offended 
      2. actions against applicable laws or ordinances
      3. violates the purpose of usage of this platform, other than recruitment or job seeking. For example, commercial / marketing promotions
      4. actions violating intellectual property rights
      5. upload, publish, send the files or programmes containing virus, Trojans, Worm, or malware that could in any way affect the operation of the platform or Service
      6. actions that could damage, disable, overburden, or impair the platform, or interfere with any other party’s use and enjoyment of the platform.
      7. actions to scrapping of the design, data, or information of HireBrilly
      8. modify the data in HireBrilly in any way, in whole or in part. HireBrilly will not accept any data or contract after modification, or
      9. actions against this Terms of Use, Privacy Policy, and any guidelines issued by HireBrilly

      HireBrilly takes no responsibility whatsoever for any material on the platform that is not posted by us, or is otherwise posted by us on behalf of a user. Also, we reserve the right to delete the content, or suspend the accounts concerned without giving any reason. In the event of any damages caused to HireBrilly, we reserve the right to take legal action against the account owner.

    2. Territory
      1. Our site is only for users in Hong Kong. We make no representation that any information (including but not limited to products, services, job posts, and promotions/marketing events) referred to on this site is available, or appropriate for use in any other locations.
      2. You may not visit or use the site and service, if you are on the government’s list of restricted end-users or are subject to sanctions in accordance with the law imposed by the government of the country where you are using HireBrilly. We can suspend your account and access to our platform, without any responsibilities and obligations to you whatsoever.
  4. Visiting the third party websites via HireBrilly
    1. Some third party web link could be shown on HireBrilly. When you are browsing the websites, you understand that those websites are not owned and operated by HireBrilly. Therefore, HireBrilly takes no liability and responsibility to the websites - you are advised to read the Terms of Service and Privacy Statement of the third party websites (if any). If you disagree or have doubts about the terms, you should stop browsing or contact the web administrator for assistance.
    2. You understand and agree that when you input data in a third party website (including but not limited to personal data, account information, payment information), it may represent your consent to sharing your data to the third party website, and HireBrilly takes no responsibility for that.
    3. You acknowledge and agree that when you browse or use third party websites, you are solely responsible and liable for any risks or damages that may occur. HireBrilly takes no responsibility and obligations to any issues concerning your usage of third party websites or the Services.
    4. You will be notified on HireBrilly of the websites / services owned by us.
  5. Account Registration and Login
    1. When you register an account on HireBrilly, you ensure the information you provided is accurate and updated.
    2. You understand and agree that HireBrilly has no obligations to provide the login details of your account, including the email address and contact number. Verification of your identity to assist your account login will not be entertained.
    3. You understand and agree that the account owners are solely responsible for the password security, and not to disclose to any other persons. Also, authorizing other persons to log in to HireBrilly accounts is strictly prohibited. Any actions with an account logged in, including but not limited to an input / edit of any information in the platform, submitting job applications, or giving statements or comments, shall be regarded as the performance of the account owner. In case the actions violate the Terms of Service or Privacy Policy of HireBrilly, or causing losses or damage, we reserve all rights to take legal actions to the account owner. 
  6. Type of Users on HireBrilly

    The following types of users view and use the platform. Click to view the terms and conditions for a particular type of user.

    1. Guest: you do not need to provide any personal information to access and view job postings on the platform
    2. Job Seeker
    3. Employer
  7. Arranging interviews on HireBrilly
    Interview arrangements on HireBrilly, including but not limited to creating an interview session, initiating an invitation to interview, arrangement updates, are solely updated by the employer. HireBrilly does not guarantee that the interview arrangements shown are up-to-date and accurate. The employer and job seeker understand and agree that HireBrilly is NOT the sole means for communications / platform for recruitment status updates. The employer and job seeker will communicate directly regarding the recruitment process. 
  8. Messages and System Notifications
    1. We do not represent or warrant that the platform runs smooth and error free, and is virus free, or preventing human error or natural disasters. And we do not guarantee all notifications sent by the system will be received by the recipient effectively.
    2. Notifications sent by HireBrilly, such as job applications, invitations / confirmations to interviews, are not considered to be the only means of communication between the Job Seeker and the Employer. You acknowledge that they are provided solely as a courtesy, and you should not rely on them. The Job Seeker and Employer are responsible to ensure effective communication with other means of communication.
    3. We do not guarantee the updates and accuracy of the recruitment status (including but not limited to confirmation on interview arrangements, job application updates, and recruitment status) shown on the platform, and take no responsibility for the communications between the Employer and the Job Seeker, which communications are both parties’ sole responsibility.
  9. Intellectual Property

    All intellectual property rights in the content, user content, design, text, graphics and other material on our site and the selection or arrangement thereof are owned, controlled or licensed by or to us. Any authorised used without our prior written permission is strictly prohibited. All trademarks, product names and company names or logos used in our site are our property or that of their respective owners. No permission is given by us in respect of the use of any such trademarks, get-up, product names, company names, logos or titles and such use may constitute an infringement of the holder's rights.

  10. Disclaimer and Limit of Liability
    1. We do not warrant that:
      1. access to HireBrilly, or any part of it, will be uninterrupted, reliable, or fault-free,
      2. contents in HireBrilly will be accurate, complete, or reliable,
      3. any services (whether or not provided by us) will be provided with due care and skill, or
      4. any products / services (whether or not provided by us) will be of merchantable quality or will be fit for any purpose (even if that purpose has been previously notified to us).
    2. If the performance by us under this platform is prevented by reason of force majeure (which shall include fire, casualty, accident, act of God, natural disaster, any law, order, declaration, regulation, demand or requirement of the Government or of any of its government agencies, strikes, labor disputes / shortage, disruption of internet / network or other causes whatsoever beyond the reasonable control of us), we shall not be liable from such performance to the extent of such prevention.
    3. As HireBrilly operates through systems which rely on communication networks, electricity networks etc., which may be beyond our control, we cannot always ensure that HireBrilly operates at all times. However, we will make all reasonable efforts to ensure our system supports the operations in connection with HireBrilly.
    4. Any failure by HireBrilly to enforce these Terms or any provision thereof shall not waive HireBrilly’s right to do so.
    5. Failure of the Company to insist upon strict performance of any provisions hereof shall not be deemed a waiver of its rights and remedies. If any provision of this Agreement is deemed by a court to be unenforceable, the remainder shall stay in effect.
  11. Others
    1. These Terms shall be governed by, and construed in accordance with, the laws of the Hong Kong Special Administrative Region.
    2. If we are going to terminate HireBrilly, we shall give you at least three (3) months’ notice by advertising on the platform.
    3. The Statement is subject to change. Unless otherwise specified, all modifications shall automatically be effective upon posting on HireBrilly and shall supersede any previous versions of these terms in Statement. You agree to review these terms regularly to ensure that you are aware of any modifications. Your continued access and/or use of our service after changes are posted constitute your acceptance of these terms as modified by the posted changes.
    4. If there is any inconsistency or conflict between the English and Chinese versions of the Statement, the English version will prevail.
